These Terms of Service govern access to and use of nobltravel.co, including purchases made through the website.

Throughout these Terms, “we,” “us,” and “our” mean NoblTravel, operated by NoblTravel LLC.

1. Acceptance and Scope

By accessing the website, creating an account, or submitting an order, you agree to these Terms and the policies referenced in them.

These Terms must be read together with our:

Shipping Policy;
Return and Refund Policy;
Payment and Billing Policy;
Privacy and Cookie Policy; and
product-specific information displayed before purchase.

Nothing in these Terms excludes mandatory consumer rights.

2. Eligibility and Permitted Use

You must have legal capacity to enter into a purchase contract.

You may not use the website:

for unlawful purposes;
to submit fraudulent or misleading information;
to infringe intellectual-property or privacy rights;

Nothing in this section limits rights where a product is defective, unsafe, damaged, incorrect, or materially misdescribed.

4. Availability

Products are subject to availability.

Adding a product to the cart does not reserve it.

If a product becomes unavailable after an order is submitted, we may offer an alternative with your approval, cancel the affected item, or issue a refund.

5. Orders and Contract Formation

Submitting an order is an offer to purchase.

An automated acknowledgement confirms receipt but does not necessarily confirm acceptance.

Unless applicable law requires otherwise, the purchase contract is formed when we expressly accept the order or dispatch it.

We may refuse or cancel an order before acceptance because of:

product unavailability;
an obvious price or description error;
failed payment;
suspected fraud;
incorrect customer information;
unsupported delivery location;

misuse of promotions or purchase limits.

Paid cancelled orders will be refunded to the original payment method.

6. Customer Information

Customers must provide complete and accurate billing, delivery, email, telephone, and payment information.

Changes cannot be guaranteed after processing or dispatch has begun.

Prices are shown in the currency displayed during checkout.

The final checkout page displays the applicable prices, discounts, shipping charges, taxes, duties collected by us, and total amount payable.

Promotions may be subject to separate conditions, dates, availability, product exclusions, and usage limits.

We may correct obvious pricing, description, availability, or technical errors.

8. Payment

Payment methods, authorization, security, fees, declined transactions, and billing procedures are governed by our Payment and Billing Policy.

9. Shipping and Delivery

Delivery areas, processing times, transit estimates, shipping costs, tracking, delays, and undeliverable orders are governed by our Shipping Policy.

Risk of loss or damage passes when the product is delivered to you or another person or location authorized by you, except where applicable law provides otherwise.

10. Cancellations, Returns, and Refunds

Order cancellation, return eligibility, return costs, exchanges, damaged products, and refunds are governed by our Return and Refund Policy.

Where customer accounts are available, you are responsible for maintaining the confidentiality of your login credentials and account activity.

We may suspend an account used fraudulently, unlawfully, or in breach of these Terms.

12. Reviews and Submitted Content

Where reviews, photographs, comments, or other submissions are accepted, you confirm that:

the submission is accurate and based on genuine experience;
you have the right to provide it;
it does not infringe another person’s rights;
it is not unlawful, threatening, abusive, or deceptive; and
it does not contain malicious software or confidential information.

We may moderate or remove content that violates these requirements.

13. Intellectual Property

Website content, including trademarks, logos, text, product descriptions, photographs, graphics, design, software, and page layouts, is owned by or licensed to NoblTravel LLC.

It may not be copied, modified, distributed, scraped, sold, or commercially exploited without permission or another lawful basis.

The website may use services provided by Shopify, payment providers, carriers, analytics providers, social-media platforms, and other independent third parties.

Their services may be governed by their own terms and privacy notices.

We are not responsible for independent third-party websites or services except where applicable law provides otherwise.

15. Website Availability

We do not guarantee uninterrupted access to the website.

Access may be interrupted for maintenance, updates, security procedures, platform failures, network disruption, or circumstances outside our reasonable control.

16. Disclaimer and Consumer Rights

The website and services are provided with reasonable care.

Nothing in these Terms excludes liability or legal obligations that cannot lawfully be excluded, including mandatory rights relating to defective, unsafe, damaged, incorrect, or misdescribed products.

17. Limitation of Liability

Subject to applicable law, we are not responsible for losses caused solely by:

unlawful or improper website use;
failure to follow product instructions;
unauthorized product modification;
inaccurate information supplied by the customer;
independent third-party conduct; or
circumstances outside our reasonable control.

We do not exclude liability for fraud, deliberate misconduct, death or personal injury where it cannot be excluded, or another liability that cannot legally be limited.

18. Indemnification

To the extent permitted by law, you are responsible for losses or claims resulting from your unlawful use of the website, violation of these Terms, or infringement of another person’s rights.

This provision does not apply where liability resulted from our own breach or misconduct.

19. Termination

We may suspend or terminate access to the website or an account where reasonably necessary because of fraud, unlawful conduct, security risks, or material breach of these Terms.

Termination does not remove obligations or rights arising before termination.

20. Force Majeure

We are not responsible for delays caused by events outside our reasonable control.

Where such an event materially affects an accepted order, we will take reasonable steps to provide information and an appropriate solution.

21. Severability and Entire Agreement

If part of these Terms is held invalid or unenforceable, the remaining provisions continue to apply.

These Terms and the policies referenced in them form the agreement governing use of the website and purchases through it.

22. Governing Law

These Terms are governed by the laws of the State of Arizona, United States.

Consumers retain any mandatory protections and jurisdictional rights that cannot legally be waived.

23. Changes

We may update these Terms by publishing a revised version with a new “Last updated” date.

Changes do not remove rights connected to orders accepted before the revised Terms became effective, except where required by law.
